URGENT CALL: AMIR facing imminent execution

AMIR AMROLLAHI (18) was sentenced to death for the murder of another boy during a fight at the age of 16. Amir’s execution order was approved by Iran’s superior court and his file was sent to the division of enforcement of the judgments. 

In an appeal letter to the head of the judiciary Ayatollah Shahroudi whose final approval is needed, Amir’s attorney Mohammad Mostafaei explained: “  On November 7, 2006, around 11:30 am, the defendant was at the bakery located on Azadegan Street in the city of Shiraz with his two friends Mr. Hassan Mohammadi and Ali Soleymani when accidentally, they ran into the victim: Mr. Mohssen Kazemi, and his friend, Mr. javad Vaziri. They engaged in a verbal argument that was completely childish and unintentional and the argument lead to a physical dispute.  At this point, Amir interfered and tried to scare off the other group with the use of a knife borrowed from his friend: Ali Soleymani, and held the knife in case it was needed for self defense. It seems the victim started to badger the defendant, who was younger than him, for no apparent reasons and provoked him.  In order to scare off the victim to leave, Amir showed off the knife.  Unfortunately the victim did not leave the premises and hit the defendant on the face. In response, Amir hit the victim with the knife’s handle, hoping that he would leave.  However, the victim stayed and due to the chaos and while the victim was walking towards the defendant with the intention of hitting him again, the defendant moved the knife towards the victim and the knife hit the victim on the right side of his chest. The defendant panicked and fled the scene and discussed the matter with his father the same day and then turned himself in to the authorities. ”

Mostafaei added : ”
Amir should be examined by the State’s medical examiners to evaluate his mental state during the conflict and at the time he committed the crime. “. He wrote : “Due to the financial situation of his family, the defendant couldn’t afford a better representation of experts in such cases and the state assigned defense attorney didn’t properly consider all the aspects of the case …….. In addition, the defendant was prescribed heavy doses of sedatives while he was held in Nezam prison (the special prison for offenders under the age of 18) and his medical file is also available, but no attention was made to this fact during the court proceedings which renders the ruling unjust. Although the defendant is remorseful, the reality is that the murder was accidental and unintentional and he was not mentally in control of his actions.”  

 

“According to eyewitnesses, when the victim was sprawled on the ground, there were many people around and near by, but none helped taking the victim to a hospital or nearest medical facilities until an ambulance arrives 30 minutes later to take Mohsen (the victim) to the hospital where he passed away. The district attorney and the honorable judges should have investigated the cause of death closely, since if the victim died due to the loss of blood which was caused by the delayed medical attention and his injuries were not fatal by nature, therefore the defendant should not have been on trial for murder, and the ruling should be considered unreasonable and therefore illegal.” Mostafaei added.

In conclusion Mostafaei wrote: ” The amendment B of the article 206 of the Islamic Penal Code states that first degree murder is an intentional act that is premeditated which result in death. However, the fact and details of the case clearly demonstrate that my client did not this act intentionally and knowingly. …..not a premeditated criminal act and only due to the victim’s persistent behavior”

As a state party to both the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), Iran has undertaken not to execute those guilty of alleged crimes committed under the age of 18. However, since 1990, the ruling Islamic regime in Iran has executed at least 30 juveniles, including more than 6 in 2007. 86 youth are now recorded by SCE to be on death row in Iran for alleged crimes before the age of 18. This number may be even higher as according to the reports, at least a further 15 Afghan juvenile offenders may be under sentence of death. According to the recent statistics provided by an Iranian police official about 170 children (under 18 at time of alleged crime) can be facing execution in Iran. There has been a surge in processing the children’s file for execution. SCE has issued 7 URGENT CALLS in the past 2 months for Ali Mahin-Torabi, Mohammad Latif, Delara DarabiHossein HaghiBehnoodAli and Saeed Jazee . Iran has broken the world records in 2007 with at least 297 recorded executions comparing to 177 in 2006.

As of January 16, 2008 Stop Child Executions Campaign has recorded 91 children facing executions worldwide: 86 in Iran, 2 in Saudi Arabia, 2 in Sudan and 1 in Yemen. In 2007 at least 7 were reported to have been executed : 6 in Iran and 1 in Saudi Arabia. Three are known to have been saved from execution: 2 in Iran and 1 in Yemen.

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English, French or your own language:


– Call on the Iranian authorities to immediately halt the execution of Amir Amrollahi.
– Express concern that Amir Amorollahi was sentenced to death for a crime committed when he was under 18;
- Calling for the death sentence against Amir to be commuted;
– Remind the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, and that the execution of Amir Amrollahi would therefore be a violation of international law;
– Urging the authorities to pass legislation to abolish the death penalty for offences committed by anyone under the age of 18, so as to bring Iran’s domestic law into line with its obligations under international law;
– Stating that you acknowledge the right and responsibility of governments to bring to justice those children suspected of criminal offences, but unconditionally opposes their death penalty.

Amir's execution order sent to be carried out

The case of Amir Amrollahi, who was sentenced to death at the age of 16 , was sent to be carried out.

Yesterday, I took over Amir’s case who was arrested at the age of 16 for alleged first degree murder and sentenced to death. After reviewing the file and due to the numerous errors, I requested a correction according to the article 18 of Public and Revolutionary Courts Procedures from the Judge. On November 7, 2006, around 11:30 am, the defendant was at the bakery located on Azadegan Street in the city of Shiraz with his two friends Mr. Hassan Mohammadi and Ali Soleymani when accidentally, they ran into the victim: Mr. Mohssen Kazemi, and his friend, Mr. javad Vaziri. They engaged in a verbal argument that was completely childish and unintentional and the argument lead to a physical dispute.  At this point, Amir interfered and tried to scare off the other group with the use of a knife borrowed from his friend: Ali Soleymani, and held the knife in case it was needed for self defense. It seems the victim started to badger the defendant, who was younger than him, for no apparent reasons and provoked him.  In order to scare off the victim to leave, Amir showed off the knife.  Unfortunately the victim did not leave the premises and hit the defendant on the face. In response, Amir hit the victim with the knife’s handle, hoping that he would leave.  However, the victim stayed and due to the chaos and while the victim was walking towards the defendant with the intention of hitting him again, the defendant moved the knife towards the victim and the knife hit the victim on the right side of his chest. The defendant panicked and fled the scene and discussed the matter with his father the same day and then turned himself in to the authorities. 


The defendant would have never thought that four of the five Judges of the privincial Penal Court would find him guilty who sentenced him to death without smallest consideration of the circumstances and his maturaity leval as an under age child.

Nevertheless, the verdict is delivered and now the case has been brought to the attention of the Head of the Judiciary to be carried out, with no regards to my client’s request for appeal.

The following points are some issues in the case against my client which would make the death sentence problematic and questionable:


1) According to one of the advisors of the 5th district court, my client at the time was only 16 years old and lacked the mental capacity of the consequences of him losing control. The advisor’s opinion merits consideration. Amir should be examined by the State’s medical examiners to evaluate his mental state during the conflict and at the time he committed the crime. There are no precise age limits mentioned in the Islamic penal code, and it’s based on the religious maturity. In other instances of the law, the lack of maturity has been discussed for a reduced sentencing, and should have been considered in the case of the defendant instead of rushing to a guilty verdict on the same day. In fact the ruling and the sentencing of this case was performed in a hasty manner and therefore does not comply with the Islamic Penal Codes.

2) Due to the financial situation of his family, the defendant couldn’t afford a better representation of experts in such cases and the state assigned defense attorney didn’t properly consider all the aspects of the case regarding the laws for the minors and he did not bring up the suspicious nature of the defendant’s mental state, probably due to his own poor health. The defendant is known to lose control of his actions under stress which should have been considered to allow an examination by the state’s medical experts to prove temporary loss of sanity.

In addition, the defendant was prescribed heavy doses of sedatives while he was held in Nezam prison (the special prison for offenders under the age of 18) and his medical file is also available, but no attention was made to this fact during the court proceedings which renders the ruling unjust.

Although the defendant is remorseful, the reality is that the murder was accidental and unintentional and he was not mentally in control of his actions.

4) The amendment B of the article 206 of the Islamic Penal Code states that first degree murder is an intentional act that is premeditated which result in death. However, the fact and details of the case clearly demonstrate that my client did not this act intentionally and knowingly.   If that were to be the case the victim would have been stabbed at the heart directly to cause immediate death. This unfortunate accident that landed the defendant in jail and the families mourning was not a premeditated criminal act and only due to the victim’s persistent behavior.

With attention to the discrepancies in the case, I hope that my client’s file would be reviewed and with the grace of God a 16 year old child’s life would be spared.

حكم اعدام امير امرالهي به اجراي احكام فرستاده شد

پرونده امير امرالهي كه در سن 16 سالگي مرتكب جرم و توسط شعبه پنجم دادگاه كيفري استان فارس محكوم به قصاص شد به اجراي احكام دادسراي شيراز ارسال گرديد 


روز گذشته وكالت امير را كه در سن 16 سالگي به اتهام قتل عمد دستگير وبه قصاص نفس محكوم گرديد را پذيرفته و پس از مطالعه پرونده چون ايرادات بسياري وجود داشت اعمال ماده 18 قانون اصلاح قانون تشكيل دادگاههاي عمومي و انقلاب را از رياست دادگستري استان فارس خواستار شدم .

در تاريخ 28/8/1384 حدود ساعت 11:30 دقيقه موكل اينجانب به همراه دو نفر از دوستان خود، به نامهاي حسن محمدي و علي سلماني در مقابل نانوايي واقع در خيابان آزادگان شيراز بوده، كه به صورت اتفاقي با مقتول آقاي محسن كاظمي و دوستش جواد وزيري برخود مي نمايند . با مشاهده همديگر و بحث ها و مشاجرات لفظي بينشان در گيري ايجاد مي شود (درگيري كاملا از روي بچگي و نا خواسته صورت پذيرفت) موكل به قصد ميانجيگري وارد معركه شده و چون علي سلماني داراي كاردي بود آنرا از او مي گيرد تا در صورت نياز از خود دفاع كند و مهاجمين را بترساند. گويا مقتول بدون هيچ دليلي موكل را كه از سن پاييني برخوردار بود مورد ضرب قرار داده و به گونه تحريك مي كند، موكل چاقو را به او نشان مي دهد تا او را بترسان كه از او دور گردد ولي متاسفانه مقتول سماجت به خرج داده و محل را رها نمي نمايد مقتول ضربه اي به صورت موكل زده و وي نيز به وسيله دسته چاقو به آرامي به صورتش زند تا شايد برود ولي مجددا مقتول در محل مي ماند و چون همه با هم درگير بودند نا خودآگاه بي عقلي نموده زمانيكه مقتول به سمت موكل مي رود تا او را مجددا بزند چاقو را به طرف او برده و ناگهان چاقو به سمت سينه راست مقتول اصابت مي كند. موكل از ترسش فرار مي كند متعاقبا در همان روز موضوع را به پدرش در ميان مي گذارد و خود را تحويل قانون دهد . موكل به هيچ عنوان فكر نمي كرد كه چهار نفر از ژنج نفر قضات دادگاه كيفري استان فارس وي را به مرگ محكوم نمايند بدون آنكه توجه اندكي به روحيات و شرايط عقلي و موقعيت وي كنند.

به هر تقدير در خصوص موكل حكم به محكوميت صادر شده و اينك با ارسال پرونده به اجراي احكام، مي بايست پرونده به نظر رياست قوه قضاييه جهت استيذان برسد هر چند موكل تقاضاي رسيدگي مجدد به پرونده خود را داده است

در پرونده تشكيل شده براي موكل اينجانب ايرادات بسياري وجود دارد كه اجراي حكم اعدام (قصاص نفس) را با شبهه و ترديد جدي مواجه مي كند به اين شرح كه:

  1. همانطور كه يكي از مستشاران محترم شعبه 5 دادگاه كيفري استان نظر داده اند موكل اينجانب در زمان وقوع جرم تنها 16 سال سن داشته و قدرت درك و فهمم به گونه اي نبود كه بتواند در برابر برخي مسايل بوجود آمده خود را كنترل كند بنابراين شايسته بود به نظر ايشان كوچكترين توجه اعمال مي گرديد و او را به پزشكي قانوني معرفي مي نمودند تا پزشكان متخصص تشخيص دهند كه آيا موكل در زمان ارتكاب جرم بالغ بوده يا خير چرا كه در هيچ جاي قانون مجازات اسلامي سن مسئوليت كيفري مشخص نشده و به بلوغ شرعي اكتفا شده است و در مواد ديگري از قانون به رافعيت مسئوليت كيفري نابالغ اشاره شده است كه تفسير به نفع متهم ايجاب مي نمود لااقل اين خواسته مطرح و مورد رسيدگي قرار مي گرفت نه اينكه به تعجيل و در همان روز رسيدگي، حكم به محكوميت وي صادر مي گرديد. اين موضوع با عنايت به اينكه در ماهيت دعواي مطروحه تاثير بسزايي دارد حائز اهميت و از موارد غير شرعي بودن حكم صادره است.
  2. چون وضعيت مالي و معيشتي موكل و خانواده اش به گونه اي نبوده است كه بتواند از وكلاي حرفه اي دادگستري و متخصص در اين امور استفاده كند متكي به وكيل تسخيري شده كه متاسفانه وكيل ايشان به دليل كهولت سن و بيماري نتوانستند موارد ابهام آور و شبهه انگيز را به درستي مطرح نمايند چرا كه وضعيت روحي و رواني موكل به گونه اي است كه در برخي از مواقع تعادل رواني خود را از دست مي دهد و اعمالي انجام مي دهد كه در حيطه اختيارش نيست بنابراين لازم و ضروري بود كه موكل اينجانب را پزشكان پزشكي قانوني مورد معاينه قرار داده و پيرامون جنونش كه به صورت موقت به سراغش مي آيد اظهار نظر مي نمودند. مضافا به اينكه موكل زمانيكه در زندان نظام ( زنداني مخصوص اطفال زير 18 سال ) بود به دليل بيماري رواني از قرصهاي آرام بخش قوي استفاده مي كرد كه پرونده پزشكي اش موجود است ولي متاسفانه به اين نكته مهم نيز هيچگونه توجهي نشد لذا دراين قسمت نيز حكم صادره مخدوش بوده و اجراي حكم بي عدالتي در حق وي مي باشد. هر چند موكل از كرده خويش نادم و پشيمان ولي واقعيت اين است كه ايشان به هيچ عنوان قصد ارتكاب قتل را نداشته و عملي را كه انجام داده ست فارغ از توان و اراده اش بوده و عالما و عامدا مرتكب قتل نشده است.
  3. همانطور كه از شهادت شهود استنباط مي شود زمانيكه متوفي نقش بر زمين شد افراد بسياري نزديك متوفي حضور داشتند ولي هيچ يك آنها را به بيمارستان و يا نزديك ترين مركز درماني نبرده تا اينكه پس از 30 دقيقه خودروي آمبولانس حاضر و محسن ( مقتول ) را به بيمارستان انتقال و ايشان در بيمارستان به رحمت ايزدي شتافتند در اين پرونده نكته مهم ديگري كه حائز اهميت است اينكه مصدوم مي بايست به سرعت به بيمارستان منتقل مي گرديد كه اين عمل پس از مدت طولاني انجام شد يعني زمانيكه خون بسياري از متوفي رفته و بي هوش گرديد. از طرفي امكانات بيمارستاني مناسبي وجود نداشت بنابراين بازپرس و قضات محترم دادگاه مي بايست به درستي تحقيق مي نمودند كه علت تامه مرگ چه بوده است اگر علت واقعا خونريزي شديد باشد و عمل نوعا كشنده نباشد قتل ارتكابي شبه عمد بوده و حكم صادره به عمدي بودن قتل بر خلاف شرع و قانون است.
  4. بند ب ماده 206 قانون مجازات اسلامي مقرر مي دارد كه هر كس عملي را عامدا و عالما انجام دهد كه نوعا كشنده باشد قتل عمد است . در حالي كه محتويات پرونده و دلايل موجود در آن نشان مي دهد كه موكل اينجانب به هيچ عنوان عالما و عامدا عملي را انجام نداده است كه نوعا كشنده باشد چرا كه اگر قصدي در مورد قتل يا عمل نوعا كشنده داشت به قلب متوفي ضربه وارد مي نمود كه اين كار را نكرده و به صورت ناخود آگاه آنهم بر اثر سماجت متوفي اين اتفاق ناگوار كه وي را زندان نشين و خانواده اش را سيه پوش كرد به وقوع پيوست.

اميدوارم با توجه به ايرادات بسياري كه در پرونده وجود دارد ، موضوع پرونده موكل مجددا مورد رسيدگي قرار گرفته تا خداي نكره خون اين پسر 16 ساله به ناحق ريخته نشود .

Three more youth sentenced to death in Iran


Stop Child Executions Campaign was informed today that three more Iranian children are facing imminent executions. The execution verdict of all three were approved by superior court of Islamic regime in Iran and their files were sent to the head of judiciary, Ayatollah Shahrudi for final approval.

AMIR AMROLAHI who is now 18 years old is sentenced to death for the murder of another boy during a fight at the age of 16. Other two boys RAHIM AHMADI and MOHAMMADREZA HADDADI are also sentenced to death for other alleged crimes at the age of 16. (More details and urgent action reports to follow.)

Nobel peace prize winner Shirin Ebadi‘s human rights group on Wednesday protesting against the amputation of hands and feet of 5 men as a punishment last week, warned:  “Unfortunately, the violation of human rights in Iran has not only been expanded in some fields, it has also found new dimensions,”  Last week two men were also sentenced to death by being dropped from height.

URGENT: 7th child offender in a month facing imminent execution


On the last days of 2007 , Stop Child Executions Campaign was informed of yet another imminent child execution in Iran (7th in the month of December!) . Iranian children rights attorney Mohammad Mostafaei sent SCE a copy of his letter to Iran’s head of Judiciary, Ayatollah Shahrudi, in which he detailed the case of Saeed Jazee, who is accused of murder at the age of 17. The alleged victim was 5 years older than him at the time. 

Saeed Jazee has been imprisoned since the age of 17 and now at the age of 21 is facing execution. His death by hanging has already been approved by Iran’s superior court and is now sent to Ayatollah Shahrudi for final approval.

Saeed’s attorney in the letter to Shahrudi explained that Saeed who is a sculpturing artist went to the sandwich shop of his close friend to eat while his family were on vacation. He picked a sandwich and started eating and the new employee, who did not know Saeed started arguing, took the kitchen knife and attacked Saeed . Saeed resisted and the knife fell and Saeed in order to scare and stop the employee picked up the knife but the employee charged towards him while Saeed was holding the knife. After being injured , Saeed tried to help and even other employees who had seen the incident hid the knife since they felt that Saeed was not at fault. Saeed’s attorney thinks that the alleged victim was the cause of his own death and he suspects that he may have been under a drug or alcohol influence and states that the body should have been tested for drugs.

Mostafaei states that Saeed did not know the victim and the murder was not premeditated and the kitchen knifewas taken by the victim who had access to the kitchen area. Mostafaei has asked for a retrial of the case.


The legal proceedings in Saeed Jazee case, like those of other child offenders facing the death penalty, may have been flawed. SCE Campaign is concerned about the use of evidence in these cases, including that of expert witnesses, where relevant, in trials, and relevant circumstantial evidences. Although
SCE campaign acknowledges the right and responsibility of governments to bring to justice those children suspected of criminal offences, but unconditionally opposes their death penalty as the International law strictly prohibits the use of the death penalty against people convicted of crimes committed when they were under 18.

As a state party to both the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), Iran has undertaken not to execute child offenders. However, since 1990, the ruling Islamic regime in Iran has executed at least 30 child offenders, including more than 6 so far this year. 82 child offenders are now recorded by SCE to be on death row in Iran. This number may be even higher as according to reports, at least a further 15 Afghan child offenders may be under sentence of death. According to the recent statistics provided by an Iranian police official about 170 children can be facing execution in Iran. There has been a surge in processing the children’s file for execution and this is the SEVENTH URGENT CALL IN ONE MONTH that Stop Child Executions Campaign had to issue, the other six being for Ali Mahin-Torabi, Mohammad Latif, Delara DarabiHossein HaghiBehnood and Ali.  

Iran executed a 20 year old boy, Makwan Moloudzadeh, earlier this month for alleged homosexuality at the age of 13. Four child offenders have been executed since October 2007: Babak Rahimi (17), Hossein Gharabaghloo (16), Mohammadreza Tork (15) Makwan Moloudzadeh (13).* [* The numbers in the ( ) indicate the age when they allegedly committed the crime for what they were executed.]

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English, French or your own language:


– Call on the Iranian authorities to immediately halt the execution of Saeed Jazee.
– Express concern that Saeed Jazee was sentenced to death for a crime committed when he was under 18;
- Calling for the death sentence against Hossein to be commuted;
– Remind the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, and that the execution of Saeed Jazee would therefore be a violation of international law;
– Urging the authorities to pass legislation to abolish the death penalty for offences committed by anyone under the age of 18, so as to bring Iran’s domestic law into line with its obligations under international law;
– Stating that you acknowledge the right and responsibility of governments to bring to justice those children suspected of criminal offences, but unconditionally opposes their death penalty.

سعيد جزي محكوم به قصاص نفس در آستانه اعدام

پروندة سعيد جزي كه در سن 17 سالگي به اتهام قتل عمد دستگير و سپس با طي تشريفات قانوني توسط شعبه 1183 به قصاص نفس محكوم  شد ، جهت اعمال مادة 205 قانون مجازات اسلامي از سوي اجراي احكام دادسراي امور جنايي تهران جهت استيذان به دفتر رياست قوه قضاييه ارسال شد.
سعيد جزي كه در هنر مجسمه سازي در كانون اصلاح و تربيت فعاليت داشته، و اكنون در زندان رجايي شهر كرج به سر مي برد در تاريخ 23/3/1382 ناخواسته و بدون آنكه سؤ نيتي در ارتكاب
 قتل عمد داشته باشد در يك درگيري بچگانه با چاقويي كه در دست مرتضي جان زمين ( مقتول ) بود وي را به صورت غير عمد به قتل مي رساند.
موكل در هنگام وقوع جرم فاقد رشد عقلاني بوده و سن و سال وي به ميزاني نبوده تا قتلي را به عمد رقم زند مضافاً به اينكه مقتول پنج سال از موكل بزرگتر بوده و با اقدامي ناشيانه و غير معقول عليه خود اين جنايت را به بار آورده است به هر حال امروز آن پسر 17 ساله به سن 21 سالگي رسيده و پشت ميله هاي زندان ، تنها اميدش به رياست محترم قوه قضاييه و اولياء دم مقتول است  تا وي را به زندگي برگردانند.
در ساعت بيست مورخ 23/3/1382 ، به دليل آنكه اعضاي خانوادة موكل در مسافرت به سر مي بردند، وي به اغذيه فروشي يكي از دوستانش كه در محلة خودشان واقع بود مراجعه       مي نمايد در آن زمان دوست موكل حضور نداشت و مرحوم مرتضي جان زمين به تازگي استخدام و مشغول به كار بود موكل از روي پيش خوان، ساندويچي برداشته و شروع به خوردن مي نمايد مرتضي چون موكل را نمي شناخت شروع به فحاشي كرده و در حالي كه لقمه در دهان وي بود ، با مشت به صورتش زده و درگيري ايجاد مي شود مقتول كه در دستش چاقوي آشپزخانه بود از پشت پيش خوان بيرون آمده و تهديد به ضربه زدن با چاقو مي نمايد موكل از بيم جانش، مقتول را به سمت ديوار هل داده و چاقو از دستان مقتول جدا مي شود موكل از ترس چاقو را بر مي دارد و در حالي كه قصد ترساندن مقتول را با چاقو  داشت مقتول به سمت موكل رفته و ناخودآگاه لبة چاقو به شكم مقتول اصابت مي كند و در نهايت با رساندن مرحوم به بيمارستان وي جان مي سپارد.
موكل در تمام مراحل دادرسي به جزء واقعيت مطلبي ديگري عنوان نكرده و تمام سعي و توان خود را به كار بسته تا مرتضي از مرگ نجات يابد. سن و سال موكل به قدري اندك بود كه متصدي ساندويچي ، موكل را دلداري داده و چاقوي آشپزخانه را پنهان مي كند .
در اين پرونده نكاتي حائز اهميت است و آن اينكه :
اولاً – موكل هيچگونه قصد و سؤ نيتي در ارتكاب جرم قتل عمد نداشته و برخلاف بند ب مادة 206 قانون مجازات اسلامي عمداً كاري را انجام نداده كه نوعاً كشنده باشد .
ثانياً – هيچگونه اختلافي بين موكل و مقتول وجود نداشته و انگيزة ديگري هم كه قصد قتل را توجيه كند در پرونده احراز نمي گردد و گزارش معاينه جسد كه علت فوت مرحوم را خونريزي داخلي و پارگي احشاء بدن در اثر اصابت جسم نوك تيز و برنده در زير جناغ سينه اعلام نموده كه مانند ناحيه قلب نوعاً كشنده نيست ، مقصود و مراد وي نبوده تا از مصاديق فعل نوعاً كشنده به شمار آيد .
ثالثاً – در پرونده به روشني علت تأمة مرگ مشخص نشده و به پاسخ كميسيون پزشكي قانوني كه در نظرية مورخ 6/8/1383 صراحتاً در پاسخ به ابهامات بوجود آمده در پرونده اعلام مي نمايند « فاصله زماني ميان ايراد جرح و انتقال به بيمارستان با انجام تحقيق قضايي روشن خواهد شد.» جامع عمل پوشانده نشده و تحقيقات در اين زمينه متوقف گرديده است.
رابعاً – درگيريهايي كه بين مقتول و موكل وجود داشت و اوضاع و احوال قضيه نشان        مي دهد كه مقتول با عصبانيت و حالتي غير متعارف و غير ارادي به سمت موكل هجوم برده و با در دست داشتن چاقو قصد درگيري فيزيكي با موكل را داشته است . اين احتمال وجود دارد كه مقتول حالت عادي نداشته و نتيجه آزمايش سم شناسي مي تواند بسياري از ابهامات را روشن نمايند در حالي كه عليرغم برداشتن خون مقتول جهت آزمايش سم شناسي، پاسخي واصل نشده و در اين خصوص نيز تحقيقي انجام نشده است .
خامساً –  ايران در سال 1354به ميثاق بين المللي حقوق مدني و سياسي پيوسته و در سال 1370 نيز كنوانسيون حقوق كودك را پذيرفته است در مادة 37 اين كنوانسيون اعدام اطفال زير 18 سال منع گرديده و با تصويب مجلس شوراي اسلامي ، اعضاي محترم شوراي نگهبان هيچگونه ايرادي به مادة فوق وارد نياورده و اينك طبق مادة 9 قانون مدني اين ماده از كنوانسيون در حكم قانون مي باشد اين موضوع نيز از ديد قضات محترم رسيدگي كننده به پرونده پنهان مانده است هر چند رويه قضايي نيز آثاري بر اين دو سند بين المللي مترتب    نمي نمايد .
به هر تقدير – اخيرا وكالت موكل را پذيرفته و هنگامي كه پروندة وي را مطالعه نمودم، متوجه شدم ابهامات و ايرادات بسياري در پرونده وجود دارد كه حكم صادره عليه موكل مبني بر قصاص نفس را با ترديد و شبهه جدي مواجه مي نمايد هر چند مي دانم كه رياست محترم قوه قضاييه و بازرسان ويژه ايشان با دقت و تيز بيني به تمامي موارد توجه نموده و اجازه نخواهيد داد موكل – هر چند مرتكب قتل غير عمد شده –  به اتهام قتل عمد و به ناحق خونش ريخته شود. طي نامه اي  استدعا نمودم تا ايشان مقرر فرمايند پرونده در اجراي ماده 18 قانون اصلاح قانون تشكيل دادگاههاي عمومي و انقلاب، مجددا مورد بررسي و رسيدگي قرار گيرد.

He is convicted of murdering a 8 year old boy called Ahmad, after rape in semi completed building 2 years ago. Ali  has confessed to the crime. He was 17 years of age at the time. A court in Tehran sentenced him to death and the sentence has been confirmed by Iran’s supreme court, and about to be carried out.

حکم قصاص جوان 17 ساله

حکم قصاص جوان 17 ساله يي که يک پسر بچه 8 ساله را پس از تعرض به قتل رسانده بود از سوي ديوان عالي کشور تاييد شد. عصر روز 27 آذر سال 84 ماموران گشت انتظامي تهران
بزرگ از کشف جسد يک پسر بچه 8 ساله در حوالي ميدان امام «شاهدشهر» با خبر شدند و با حضور در محل دريافتند جسد پسر بچه 8 ساله يي به نام احمد در حاشيه اين ميدان رها شده و آثار ضرب و جرح بر پيکر اين کودک مشهود است. با آغاز تحقيقات پدر احمد گفت به يکي از دوستان فرزندش که نوجواني 17 ساله به نام علي است مشکوک است. به اين ترتيب علي دستگير شد و در اعترافي تکان دهنده گفت ظهر روز حادثه احمد را به داخل يک ساختمان نيمه کاره کشاندم و به وي تعرض کردم و سپس از ترس تصميم گرفتم او را بکشم. با توجه به اعتراف علي و همچنين تکميل پرونده قاضي شعبه 74 دادگاه کيفري استان تهران براي وي در روز اول مرداد سال جاري حکم قصاص صادر کرد که اين حکم از سوي شعبه 39 ديوان عالي کشور تاييد شد

حكم قصاص پسر جوانى كه در اقدامى جنون آميز پسر بچه اى را به قتل رسانده پس از تأييد در ديوان عالى كشور به دادسراى جنايى تهران ارسال شد.به گزارش خبرنگار جنايى ما، محكوم ۱۹ ساله، دو سال قبل پس از آزار و اذيت پسر هشت ساله اى به نام احمد، وى را در ساختمانى نيمه كاره در يكى از محله هاى شهريار به قتل رساند و گريخت.پس از شكايت پدر پسر بچه و تحقيقات گسترده پليس سرانجام متهم دستگير و به قتل اعتراف كرد.با توجه به درخواست اولياى دم و اسناد و مدارك موجود در پرونده ، حكم اعدام متهم از سوى شعبه ۷۴ دادگاه كيفرى استان تهران صادر شد. شعبه ۳۹ ديوان عالى كشور نيز حكم را تأييد كرد.قاضى عصمت الله جابرى رئيس شعبه اجراى احكام دادسراى جنايى تهران در اين باره گفت: پرونده محكوم به مرگ به دادسراى جنايى ارسال شد تا پس از انجام مراحل قانونى وى به دار مجازات آويخته شود

URGENT: Another child offender facing imminent execution

A young man identified as Behnood could be facing execution soon, reported few of Iran’s news agencies today. He is convicted of murdering a 19 year old boy called Ehsan, with a soda bottle during a street fight two years ago. Behnood was 17 years of age at the time. A court in Tehran sentenced him to death and the sentence has been confirmed by Iran’s supreme court, and about to be carried out.

Fars news agency reported that the parents of Ehsan have asked for Ghisas (punishment by execution) and Iran’s mediation departments are trying to obtain the victims parents pardon to prevent execution. There was no mention if the execution has been approved by Iran’s head of judiciary or not.

– reminding the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, and that the execution of Hossein Haghi would therefore be a violation of international law;

حكم قصاص جوان 17 ساله‌ براي اجرا فرستاده شد

حكم قصاص جوان 17 ساله‌اي كه يك جوان 19 ساله را با ضربه شيشه نوشابه به سرش به قتل رسانده بود براي اجرا به واحد اجراي حكم دادسراي امور جنايي تهران رفت.به گزارش خبرنگار اجتماعي فارس، ساعت 23 روز 27 مرداد سال 84 ، مأموران كلانتري ونك از وقوع يك درگيري و نزاع منجر به فوت يك جوان 19 ساله با خبر شدند
مأموران با حضور در صحنه دريافتند فردي به نام بهنود 17 ساله با شخص ديگري به نام احسان 19 ساله درگير شده و در اين درگيري بهنود با ضربه شيشه نوشابه به سر احسان،؛ وي را مجروح و به قتل رسانده است
جابري قاضي واحد اجراي احكام دادسراي امور جنايي تهران در خصوص اين پرونده گفت: بهنود متهم به قتل در بازجويي ها به قتل احسان اعتراف كرده و مدعي شد عصر روز حادثه با گروهي از دوستان احسان درگير شده و با آنها جر و بحث كرده اما شامگاه همان شب احسان به همراه دوستانش به محله ما آمده و مدعي شد قصد گرفتن انتقام از من را دارد
وي ادامه داد: بهنود در ادامه دفاعياتش مدعي شد احسان در درگيري به خانواده‌اش فحاشي كرده و بهنود نيز كه از اين موضوع عصباني شده است با وارد كردن ضربه شيشه نوشابه به سر وي او را مضروب و سپس به قتل رسانده است
قاضي واحد اجراي احكام دادسراي امور جنايي تهران گفت: با توجه به مجرم شناخته شدن بهنود و درخواست اولياي دم مبني بر قصاص وي شعبه 74 دادگاه كيفري استان تهران براي وي حكم قصاص صادر كرد كه اين حكم از سوي شعبه 32 ديوان عالي كشور تائيد شد
جابري افزود: در حال حاضر واحد صلح و سازش دادسراي امور جنايي تهران در تلاش است تا بتواند رضايت خانواده مقتول را مبني بر عدم اجراي حكم قصاص بهنود بگيرد
