The story of a pending execution

Last week an email was sent to Nazanin Afshin-Jam from an Iranian girl by the name Azarin asking Nazanin to help a friend of her whose young nephew was facing execution in Iran. No name or information was given at the time, so we asked for more detail information which was sent to us by the family member. It was only then that we realized that the boy’s name is Ali Mahin-Torabi who was already listed in Stop Child Executions Petition. In the past few day we have posted more information about Ali’s situation and also have contacted Amnesty International, International Committe Against Executions and Iranian Attorney Mostafaei who has already met Ali in prison and taken his case. This is an essay about Ali Mahin-Torabi that Azarin sent us today:

Today my friend in Iran called me. She told me about the imminent execution of Ali Mahin Torabi, her nephew. He’s 21 years old, and he has been declared guilty of a murder he hasn’t committed. He has spent the last five years of his life—since he was 16 years old–in a prison, waiting for his execution. After his arrest, if Ali hadn’t protected his friends by taking the blame, or if he had a rich family, or if his father had better connections, and if there was a true justice system in Iran based on the Justice and the Truth, maybe he wouldn’t have been where he is now. Still during these five years in prison, Ali studied hard to get his high school diploma and now he has also the responsibility of their library’s computer systems.

He is still full of life and hope but my friend sounded so desperate.

She asked me to help Ali.

I write this with that task weighing heavily upon my shoulders. Where to begin?

I searched the Internet and was stunned to learn there are at least another 80 children in the same situation as Ali—young people waiting to be executed for crimes they allegedly committed when they were minors. One on this sinister list is a 13-year-old girl.

I stare in horror at the images on the internet of countless public hangings. In the crowds watching this vision of horror, stand children, and all I can think about is what lessons they are learning. They stare at the soulless eyes of an alleged criminal, the one who will, in just one second, become a victim. Then I find another image: a hanged woman in black chador dancing in the air; the figure is imposing and sinister, and isolated. It’s as if this picture belongs to another place, another race, another dimension. It’s as if time has stopped, and all humanity is linked through one hanged woman’s despair.

My mind drifts.

No, I think. I don’t need to look at this image. I don’t need to write this nightmare. Why should I write such a story? This is a vision I don’t want to see. These are words I don’t want to read. There is this crushing silence I don’t want to break.

I think: There is this truth I don’t dare defy.

The weight on my shoulders grows heavier….still more.

Should I contact humanitarian organizations? Should I send letters and emails? Should I make phone calls?

What can I actually achieve?

I am not in Iran. I am not a lawyer. I have no important connections. I am nobody. What can I do other than write about Ali who sits awaiting execution for a crime he did not commit, who has sat there, among so many others, for so many years?

How am I supposed to tell his story?

This story should stab, Kafka wrote.

That means Ali’s story should shock and awaken. That means I should dream about it, over and over and over again. That means I should change and change again my wording to hone the piece until it is pure perfection. That means I should fall asleep every night repeating this same story, to find the exact place of each word in the flow of my narration. Each word has to be where it should be. My story must reveal the randomness of this cruelty, and I must mention hope, and yes, even love. I know I have to please all those who read it and move those who have never cared—not for innocents hanged, not for young men and women in Iran, not for others. I know I must convey impossible empathy, and I must do this only with my words and even through the blank gaps between words. I must push you, my reader, to read on and at the same time make the reading of Ali’s fate harder and harder to bear. So you will suffer alongside Ali who sits alone in his cell, imagining a rope, imagining a hand, imagining the void beneath his feet – for the one millionth time.

It is how, all of us, we will never leave this moment, this moment of a man’s tangible sorrow.

It is how we will share his futureless existence; we will believe his beliefs and we will sink in the pool of his despair. We are going to belong to that place, to that hanging place, where we will turn into Ali.

But maybe for once, only this time, we will not shut our mouths out of fright. For once, we will be united – no matter where we come from, and we will shout and scream: “Stop it. Stop the execution of Ali. Stop the execution of children in Iran.”

But? How? How do I begin to tell this story?

How is it going to end?

How will my writing save Ali?

علی مهین ترابی 16 ساله محکوم اعدام

علی مهین ترابی  متولد 17/2/1365 می باشد مه در تاریخ 14/11/1381 به اتهام قتل عمد بازداشت و به اعدام محکوم شده است .

خلاصة جريان پرونده :

وفق گزارش مورخ 14/11/1381 كلانتري 15 رجائي شهر كرج يك فقره درگيري و منازعه در خيابان نهم شرقي جلوي هنرستان هاشمي اتفاق افتاده و فردي بنام علي مهين ترابي فرزند محمدرضا 16 ساله با ايراد ضربة چاقو  فرد ديگري را بنام مزدك خداداديان مجروح مي نمايد علی پس از دستگیری ضمن اعتراف به استفاده از چاقو اضافه مي كند كه من چاقو را از جيب درآورده و باز كردم و حتي عقب هم رفتم كه مقتول به سمت من نيايد كه به علت ازدحام نامبرده را هل دادند فقط متوجه شدم چاقويم بريده و نفهميدم كه وي چگونه چاقو خورده كه به صداي داد و فرياد  بچه ها كه مزدك چاقو خورده متوجه شدم كه نامبرده از بدنش خون       مي ريزد ( ص 3 تا 5 پرونده ) پرونده بدواً به شعبة 45 دادگاه عمومي كرج ارجاع كه متهم در جلسة مورخ 15/11/1385 دادگاه نيز همين مطلب را با توضيح بيشتر بيان مي دارد ( ص 6 تا 8) و سپس با انجام اقدامات و تحقيقات لازم به موجب قرار عدم صلاحيت به لحاظ سن متهم (ص 58 ) پرونده در شعبة 33 دادگاه عمومي ويژة رسيدگي به جرائم اطفال مطرح رسيدگي واقع مي شود علی در جلسة مورخ 19/11/1381 اين دادگاه نيز مطالب قبلي خود را تكرار مي نمايد فرد ديگري به نام عزت اله اروج زاده فرزند اروج  که در درگیری حضور داشت مي گويد : ……زنگ آخر شد و ما جلو مدرسه ايستاديم تا مزدك بيايد او آمد و با علي درگيري لفظي پيدا كردند و بعد هم بين او و علي درگيري بوجود آمد و علي يك ضربه به صورت او زد كه عينك او به زمين افتاد بعد هم من مزدك را به عقب كشيدم و مزدك به زمين خورد و بچه ها از پشت من را نگه داشتند و مزدك بلند شد و به سمت علي رفت كه من در آن لحظه دو ، سه متري با آنها فاصله داشتم كه علي در آن موقع با چاقو زده بود و بعد هم من علي را كشيدم كنار و بچه ها گفتند كه او را با چاقو زده است و من ديدم كه او به سمت علي آمد و فحش داد و بچه ها به او گفتند كه از بدنت دارد خون مي آيد بي هوش شد ( ص 62 تا 65 ) مجروح پس از انتقال به بيمارستان فوت كرده و پزشكي قانوني به شرح برگ گزارش معاينة جسد علت آنرا خونريزي وسيع داخلي بعلت پارگي قلب و عروق حياتي آن بر اثر اصابت جسم نوك تيز و برنده اعلام   مي نمايد ( ص 104 ) مادر مقتول گذشت خود را از قصاص و مطالبة ديه اعلام مي دارد ص(106 ) بالاخره آخرين جلسة دادگاه در تاريخ 29/7/1382 با حضور پدر مقتول و متهمان و وكلاي مدافع آنان تشكيل مي شود كه پدر مقتول تقاضاي مجازات قصاص نفس براي متهم به قتل بنام علي مهين ترابي نموده و شكايت خود از عزت اله اروج زاده را به قانون واگذار        مي نمايد چرا که علی مدعی بود عزت اله مقتول را به طرفش هل داده است . متهمان و وكلاي آنها نيز به دفاع از خود و موكلان خود مي پردازند ( ص 227 تا 229 ) نهايتاً دادگاه در تاريخ 5/8/1382 با ملاحظة محتويات پرونده ختم رسيدگي را اعلام و مبادرت به صدور دادنامه شمارة 82/915 مي نمايد و به موجب آن توجهاً به تحقيقات انجام يافته و دفاعيات متهمان و شكايت شاكي خصوصي و نظرية پزشكي قانوني متهم رديف اول آقاي علي مهين ترابي را به تحمل مجازات قصاص نفس با پرداخت سهم دية مادر مقتول از سوي پدر وي كه متقاضي قصاص است و متهم رديف دوم آقاي عزت اله اروج زاده را به تحمل سه سال حبس به جرم شركت در نزاع دسته جمعي محكوم و نفر اخير الذكر را از اتهام معاونت در قتل تبرئه مي نمايد ص ( 238 تا 239 ) اين رأي در تاريخ 15/9/1382 به وكيل محكوم عليه رديف اول ص ( 255 ) ابلاغ و درخواست تجديدنظر وي در تاريخ 27/9/1382 به دفتر دادگاه و اصل پيوست پرونده و به ديوانعالي كشور ارسال كه به  شعبه بیست و هفت دیوانعالی کشور ارجاع می گرديدد.

هيئت شعبه در تاريخ بالا تشكيل گرديد پس از قرائت گزارش آقاي مالك اژدر شريفي عضو مميز و اوراق پرونده دادنامه شماره 915/مورخ 8/8/1382 تجديدنظر خواسته مشاوره نموده چنين رأي مي دهند :

با توجه به محتويات پرونده و احراز بزهكاري متهم علي مهين ترابي از سوي دادگاه كه ظاهراً قاضي محترم محكمه علم به قاتل بودن وي پيدا كرده هر چند به بندهاي چهارگانة ماده 231 و مادتين 105 و 120 قانون مجازات اسلامي اشاره و قيد ننموده ولي از مجموع اظهارات و اقارير متهم به اينكه چاقو را از جيبش در آورده و باز كرده …….و اينكه ادعا نموده كه ديگران او را هل داده اند الخ موجه و مدلل نيست به ضميمة گواهي پزشكي قانوني و گواهي گواهان در مجموع زمينه براي حصول علم به نحو متعارف فراهم است و درخواست تجديدنظر از سوي وكيل نامبرده با هيچ يك از شقوق مذكور در مادة 240 قانون آیین دادرسی کیفری انطباق ندارد و مردود است لذا دادنامه تجديد نظر خواسته در مورد حكم قصاص ياد شده ابرام مي گردد.

در حال حاضر پرونده در اجرای احکام دادسرای عمومی و انقلاب کرج بوده و یک بار جهت استیذان به نظر ریاست قوه قضاییه رسید که ایشان دستور فرمودند موضوع با صلح و سازش از طریق یکی از شوراهای حل اختلاف حل شود . متاسفانه پدر مقتول مصرانه خواستار قصاص می باشند . در صورتی که پدر مقتول مبلغ دیه مربوط به سهم مادر را پرداخت کند علی مهین ترابی اعدام خواهد شد . لذا از این لحاظ جای نگرانی شدید وجود دارد مضافا به اینکه اینگونه افراد در زندان به دلیل بلاتکلیفی خود از لحاظ روحی و روانی آسیب دیده و مجازاتی مضاعف را تحمل       می کنند . از طرفی از لحاظ قوانین بین المللی به خصوص میثاق بین المللی حقوق مدنی و سیاسی که ایران نیز آن را پذیرفته است اطفالی که در زمان ارتکاب جرم سنشان زير 18  سال بوده نباید اعدام گردند .

URGENT ACTION: Another Child facing imminent execution in Iran (UPDATED)

Ali Mahin-Torabi is another youth who was sentenced to death for murdering another youth, Mazdak Khodadadian, during an argument in Bani Hashemi High School in February 2003. According to Ali’s testimony, he did not know Mazdak had been stabbed until he heard shouting from the crowd that had gathered around them.

A Juvenile Court in city of Karaj (near Tehran) sentenced Ali Mohin-Torabi to qisas on October 30, 2003. Branch 27 of the Supreme Court upheld the sentence on June 8, 2004. In cases of Qisas sharia law, the family of the murdered have the options of demanding execution of the accsued, demand Diyeh retribution (blood money) or pardon the accused. In this case Mazdak’s mother demanded blood money, but if the father pays the requested amount to the mother, Ali Mahin-Torabi’s will get executed.

International Committe Against Executions, had initially reported that Ali’s death sentence was approved by Iran’s head of judiciary Ayatollah Sharudi. Stop Child Executions Campaign contacted attorney Mohammad Mostafaie in Iran. Mr. Mostafaei immediately met Ali in prison and took his case. We were also informed that the case had been sent to Ayatollah Shahrudi but he did not order the final execution order (Estizan) and instead ordered that the the matter attempted to be resolved by arbitration. If the arbitration fails and Mazdak’s father does not settle , Ali’s execution will be carried out. Ali Mahin-Torabi is now in Reja’i Shahr prison in Karaj.   

As a state party to the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), the government of Iran has undertaken not to execute anyone for an offense committed when they were under the age of 18.  There are currently at least 80 children on death row in Iran.

Nazanin Afshin-Jam and Stop Child Executions Campaign strongly condemn the pending execution of Ali Mahin-Torabi and demands an immediate halt to carrying Ali’s execution verdict. 

We also demand the Iranian parliament and judiciary as well as the supreme leader of Islamic regime in Iran Ayatollah Khamenei and Ayatollah Shahrudi , the head of Iran’s judiciary to immediately implement the letter of the 55 Iranian attorneys and human rights advocates last week who demanded an immediate halt to all child executions and a speedy approval of the parliamentary bill to permanently prohibit execution of minors.

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English or your own language:

– expressing concern that Ali Pak-Mihan is at risk of execution for a crime committed when he was under 18;

– calling on the authorities to halt the planned execution of Ali Mahin-Torabi immediately, and commute his death sentence;

– reminding the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, and that the execution of Ali Pak-Mihan would therefore be a violation of international law;

– urging the authorities to pass legislation to abolish the death penalty for offences committed by anyone under the age of 18, so as to bring Iran’s domestic law into line with its obligations under international law;

– stating that you acknowledges the right and responsibility of governments to bring to justice to those suspected of criminal offences, but unconditionally opposes their death penalty.

Another 16 year old Iranian boy sentenced to death in Iran

September 16, 2007: An Iranian court sentenced two teenagers to death on the charges of rape and murder, the state-owned Iran daily reported. The court in Shiraz, 900 kilometers south of Tehran, sentenced Reza, 16, and Mohammed, 18, to death for raping and killing 9 year old Karim Tajik and 10 year old Mohammed Shiri in April, 2007.
The teenagers were also sentenced to three years in prison and 100 lashes.

According to the newspaper, the suspects confessed to raping the boys, tying them up and then tossing them into the river in Marvdasht town to drown them. There were two other suspects in the crime, one of whom was acquitted and the other sentenced to flogging.

12 year old child facing beheading in Saudi Arabia

According to sueddeutsche.de,  on Monday Al Riyadh, a Saudi Arabian newspaper, reported that a 12 year old boy is awaiting to be beheaded for an alleged murder of another Saudi boy. Meanwhile the boy’s mother is trying to collect the “blood money” to pay to the family of the alleged victim. According to Al-Riyadh, The victims family has demanded three million Rials (about $800,000 USD) to pardon the boy.

The boys mother has only been able to collect less than 10% of the money (250,000 Rials) and has asked for donations to save her son’s life from imminent execution.

Background Information: Saudi Arabia beheaded another child last month. Due to the strict secrecy of the criminal justice system, it is not possible to know how many juvenile offenders have been put to death in Saudi Arabia, but according to a media report, over 100 juvenile offenders are said to be on death row. They include Rizana Nafeek, a Sri Lankan national who was 17 at the time of the alleged murder for which she was sentenced to death following her arrest in 2005. They may also include Sultan Kohail, a 16-year-old Canadian national who was tried early this year on murder charges along with his brother Mohamed Kohail, aged 22. Trial proceedings usually take place behind closed doors without adequate legal representation, and invariably fall short of international fair trial standards. Both children and adults are often convicted on the basis of “confessions” obtained under duress, including torture or other ill-treatment during incommunicado detention. International law prohibits Saudi Arabia from executing people for crimes committed when they are below the age of 18. Saudi Arabian officials have maintained that they comply with this obligation, contained in the Convention on the Rights of the Child.

Stop Child Executions Campaign strongly condemns child executions by Saudi Arabia and demand an immediate halt to this practice.

URGENT ACTION: Write to following Saudi leaders referring to the Saudi newspaper report and demand a stop to the execution of children in compliance with UN children Rights Conventions.

More countries condemn imminent execution of Behnam Zare

More countries support European Union in urging the Islamic Regime of Iran to halt the execution of Behnam Zare:

The EU is deeply concerned by the news of the imminent execution of Mr Behnam Zare, who was sentenced to death by a judge of the Shiraz Court for a crime committed when he was a minor.

The EU recalls the Islamic Republic of Iran’s international commitments, and specifically the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, both clearly prohibiting the execution of minors or people who have been convicted of crimes committed while they were minors.
 
The EU urges the Islamic Republic of Iran to comply with International Law and to halt the execution of Mr Zare, and of all other juvenile offenders, taking in consideration alternative sentences for juvenile offenders.

The EU also calls on the Islamic Republic of Iran, in the advent of the month of Ramadan, to announce a temporary halt to all executions in order to initiate an urgent review of Islamic Republic of Iran’s international position and to remind the Judiciary of Iran’s international obligations.
 
The Candidate Countries Turkey, Croatia* and the former Yugoslav Republic of Macedonia*, the Countries of the Stabilisation and Association Process and potential candidates Albania, Bosnia and Herzegovina, Montenegro, Serbia, and the EFTA countries Iceland, Liechtenstein and Norway, members of the European Economic Area, as well as Ukraine, the Republic of Moldova and Georgia align themselves with this declaration.

* Croatia and the former Yugoslav Republic of Macedonia continue to be part of the Stabilisation and Association Process.

EU, Canada, Norway, Croatia , Canada and Australia urge Iran to halt execution of Behnam Zare

After Stop Child Execution Campaign was notified of the imminent execution of Behnam Zare by his atorney Mohammad Mostafaei; Nazanin Afshin-Jam and SCE contacted Amnesty International which resulted in their issuance of an international Urgent Action Call. Nazanin Afshin-Jam also has contacted the office of Ms. Louise Arbour, the High Commissioner for Human Rights at United Nations and her office has “provided the the information to the human
rights mechanisms in Geneva for their attention.”

Also after learning about scheduled execution of Behnam Zare, the presidency of the European Union sent issued an statement, urging the Islamic regie in Iran to halt the execution. Additionally the governments of Australia, Croatia, Canada and Norway supported the statement. 

SCE is hopeful that as a result of the created international pressure , Behnam to be saved from execution.

حسین حقی 16 ساله متهم به قتل است در ساعت 19:40 دقیقه مورخ 21/5/1382 مامورین گشت کلانتری 108 مشاهده می کنند دو مرد جوان در حال فرار هستند و عده ای آنها را تعقیب می کنند مامورین دو نفر مرد جوان را که خودشان را حسین حقی و امراله تاجیک معرفی می کنند دستگیر نموده و یکی از دوستان آنها توسط کسبه محل دستگیر می شود مامورین متوجه  می شوند که بین دستگیر شدگان و عده ای دیگر درگیری به وجود آمده و یک نفر به نام مهدی خلیلی مورد ایراد ضرب قرار گرفته و در اثر اصابت جسم تیز و برنده به قفسه صدری سینه و شدت جراحت وارده فوت نموده است حسین حقی در ابتدای بازجویی پس از تفهیم اتهام ماجرا را شرح داده و می نویسد از خیابان زنجان در حال حرکت بودیم برای دستشویی به یک خانه نیمه ساز رفتم دیدم پسر جوانی با یکی از دوستان من درگیر شده ، من آنها را جدا کردم ولی پسرک جوان می گفت من بچه کوچه مبارز هستم ناگهان دوباره با ابراهیم درگیر شد و به دوستش گفت به بچه ها بگو از مغازه بیایند ناگهان پسر قد بلندی آمد  و با میله به سر من و امراله زد . من دستهای او را گرفتم و گفتم نزن ما دعوا نداریم و پسرک را با حرفهای خود قانع نمودم که ناگهان از پشت پسرک قبلی مشت پرتاب کرد و مرا از پشت گرفت و زد من پسرک را از خودم جدا نمودم و از داخل جیب خود تکه ورق کالواریزه که بی مورد داخل جیبم بود در آوردم و دیدم پسرک جوان با شلنگی که از داخل ساختمان بیرون آورد به من حمله ور شد و من دست خود را بالا گرفتم تا به من اصابت نکند ناگهان تیغ از دست من رها شد و به زیر ماشین افتاد …. .
حسین متعاقبا به این صورت اقرار نموده که چاقو در دستش بوده و در حالیکه ترسیده بود به قصد ترسندن مقتول آن را به ناحیه سینه مقتول زده است او در دادگاه در حضور قضات شعبه 74 کیفری استان اظهار نمود که چاقو را را در از جیب در آورده ، ولی به بدن مقتول نزده است و در این حین مردم فریاد زدند که قاتل را بگیرید .در نهایت دادگاه در تاریخ 19/11/1382 مبادرت به صدور حکم به قصاص نفس (اعدام) حسین حقی  صادر می نماید و قضات  شعبه 27 دیوانعالی کشور نیز در تاریخ 4/4/1383 با این استدلال که حصول علم با وجود زمینه مناسب جهت حصول علم از طریق متعارف که عمدتا اقاریر و اعترافات صریحه و مشروحه اولیه متهم می باشد حکم صادره را تایید  می نمایند.
 در حال حاضر پرونده جهت بررسی مجدد با اعتراض متهم در شعب تشخیص دیوانعالی کشور در حال رسیدگی می باشد.
نکاتی در این پرونده قابل تامل است و آن اینکه قتل در اثر نزاع دسته جمعی اتفاق افتاده که اکثریت افراد داخل در دعوا از آلت قتاله استفاده کرده اند متهم در رسیدگیهای اخیر قضایی منکر اصابت ضربه به بدن مقتول شده و با توجه به اینکه سن ایشان در زمان قتل 17 سال بیشتر نداشت مشخص نیست که آیا واقعا قاتل حسین حقی بوده است یا خیر . مضافا به اینکه حکم صادره بر اساس علم قاضی صادر شده است .
