Iran’s Ruling Regime Violates It’s Own Laws by Murdering Makwan Moloudzadeh

This week, 20 year old Makwan Moloudzadeh was executed for alleged sexual activity with other boys at the age of 13.  Makwan was initially arrested for smoking during Islamic fasting month of Ramadan.  In a show of humiliation was placed on a donkey and taken around the town in city of Kermanshah.  Several days later 3 boys told the authorities that Makwan had sexual relationship with them when he was 13 years of age. Despite the fact that the boys later withdrew their allegations, Makwan was sentenced to death for these alleged sexual acts. 

Subsequently, Makwan’s case was appealed and was under review by direct order of Iran’s head of judiciary, Ayatollah Shahrudi. Although Makwan’s attorney was told that the case will remain in Iran’s superior court in Tehran for more than 2 months, without his knowledge the file was sent back to prison authorities in Kermanshah and Makwan was executed in prison two days ago.

Makwan’s parents and his attorney, who were not notified of the execution in advance, were told after his death to make arrangement to pick up his body. The circumstances under which Makwan’s sentence was ordered and carried has not been not disclosed by the authorities.  It has been reported that the authorities said that they needed to make an example for the other youth in the community.
By executing Makwan for alleged sexual acts at the age of 13 Iran has violated its obligations not to execute children for crimes committed under the age of 18 pursuant to the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC).  He was executed based upon recanted allegations of three individuals concerning something that allegedly occurred over seven years ago.  The allegations were obtained under duress, and the proceedings violated both procedural and substantive due process.
Iran has violated its own laws in the following manner:
– Execution without any proof based on hearsay of 3 individuals who later testified that had lied.
– Execution for an alleged crime at the age of 13.  (Boys are considered adult at the age of 15 under Iran’s Islamic Sharia law and therefore even under Iran’s law Makwan was considered a child and should not have been executed.)
– Execution without approval of Iran’s head of judiciary, Ayatollah Shahrudi. (Unless Ayatollah Shahrudi had personally signed the execution order of Makwan, those who are sentenced to death for alleged crimes before the age of 18 can not be executed.)
– Execution without due process as provided within Iran’s penal codes.
– Execution without notifying Makwan’s attorney of the status of his case.
– Execution without notifying Makwan’s family that he was going to be executed.
According to Iranian law passed in 1991,  48 hours before execution the following people must be notified:
1- The local police to maintain security during the execution
2- The head of prison in order to assure of proper execution procedures
3- A Reliable physician to ascertain the status of the health of the accused
4- The religious authority of the religion of the accused (if s/he is of an accepted religion within Iran’s constitution)
5- The Court Secretary to recite the verdict
6- The Attorney of the accused
7- The Parents and nearest relatives of the accused
Additionally, the judge ordering the execution must allow the victim to meet those with whom he wishes to meet as long as it does not cause delay in execution.
After the completion of the execution, a complete report must be prepared and signed by all the above listed people to be included in the file along with a photo of the execution. The information and the name of the accused must be reported to the newspapers.
It is obvious that in the case of Makwan and many others, Iran’s authorities continue to violate even their own laws.
According to a recent confession by an Iranian police official there are nearly 240 other minors who may be facing execution in Iran not to mention more than 80 minors who have been identified and reported by Stop Child Executions Campaign.
Stop Child Executions Campaign strongly condemns the barbaric execution of an innocent child by the Islamic Regime in Iran in violation of International law as well Iran’s own laws. We further demand an international condemnation of Iran’s regime for this murder and demand that those responsible be held accountable in the international community and in the Iranian courts.
We call on the United Nations to take a more proactive role in holding Iran’s regime accountable for the recent executions and murders and to institute formal proceedings against those guilty of these crimes against humanity.

(New York, Wednesday December 5, 2007) – The International Gay and Lesbian Human Rights Commission (IGLHRC) has learned today that despite an order by the Iranian Chief Justice to nullify his death sentence, Mr. Makvan Mouloodzadeh was executed in Kermanshah Central Prison at 5 a.m. this morning, Iranian time. Neither Mr. Mouloodzadeh’s family or his lawyer were told about the execution until after it occurred. IGLHRC is still investigating the facts in this case.

“This is a shameful and outrageous travesty of justice and international human rights law,” said Paula Ettelbrick, IGLHRC’s executive director. “How many more young Iranians have to die before the international community takes action?”

Mr. Mouloodzadeh was a 21-year-old Iranian citizen who was accused of committing anal rape (ighab) with other young boys when he was 13 years old. However, at Mr. Mouloodzadeh’s trial, all the witnesses retracted their pre-trial testimonies, claiming to have lied to the authorities under duress. Makvan also told the court that his confession was made under coercion and pleaded not guilty. On June 7, 2007, the Seventh District Criminal Court of Kermanshah in Western Iran found him guilty and sentenced him to death. Despite his lawyer’s appeal, the Supreme Court upheld his death sentence on August 1, 2007. The case caused an international uproar, and prompted a letter writing campaign by IGLHRC and similar actions by Amnesty International, Human Rights Watch, Outrage! and Everyone Group.

In response to mounting public pressure, and following a detailed petition submitted to the Iranian Chief Justice by Mr. Mouloodzadeh’s lawyer, the Iranian Chief Justice, Ayatollah Seyed Mahmoud Hashemi Shahrudi, nullified the impending death sentence of Mr. Mouloodzadeh. In his November 10, 2007 opinion (1/86/8607), the Iranian Chief Justice described the death sentence to be in violation of Islamic teachings, the religious decrees of high-ranking Shiite clerics, and the law of the land.

In accordance with Iranian legal procedure, Mr. Mouloodzadeh’s case was sent to the Special Supervision Bureau of the Iranian Justice Department, a designated group of judges who are responsible for reviewing and ordering retrials of flawed cases flagged by the Iranian Chief Justice. However, in defiance of the Chief Justice, the judges decided to ratify the original court’s ruling and ordered the local authorities to carry out the execution.

Mr. Mouloodzadeh’s execution came days after a panel at the UN General Assembly passed a resolution calling for a moratorium on the death penalty.

Makwan Moloudzadeh is executed

The news has just reached us. Makwan was executed last night (local time) in Dizel Abad Prison in the city of Kermanshah. Makwan’s family have just collected his body and are on their way to the city of Paveh. Around 200 cars are following in procession the car carrying the body of a youngster murdered in cold blood by a bunch of criminal thugs.

This crime must be recorded in history. Not only that – the criminals in power in Iran must be indicted through international courts. Makwan had not committed any crime. He was executed for a sexual relation with a class mate when they were both 13. He was executed for homosexuality.

The International Committee Against Executions, along with several human rights organisations, including Amnesty International, launched a campaign to save Makwan. As a result of these actions, the head of the judiciary, Shahroudi, was forced to call for a review of the case, saying that the death sentence was incorrect.

According to our information, the local authorities in Paveh and Kermanshah were insistent that the death sentence should be carried out. One of the officials is reported to have said “Paveh’s youths have become too cheeky; we should execute one so that it may be a lesson to others”.

The Islamic regime executed young Makwan because it wanted to create a climate of fear. The prison authorities even said to the family of Makwan that they had been good enough not to execute him publicly.

Since the announcement of the news of Makwan’s execution at the hands of Islamic hangmen, a wave of sympathy and solidarity has swept the city.

The International Committee Against Executions strongly condemns this savage and despicable crime by the Islamic Republic, and calls on the people of Paveh and Kermanshah to extend their sympathies and support to Makwan’s family.

Our Committee will pursue this crime through international bodies so that the murderers may be prosecuted.

ماکوان مولودزاده اعدام شد

روز پنجشنبه، 6 دسامبر (15 آذر)، گزارش شد که حکم اعدام ماکوان مولودزاده، بیست ساله و ساکن شهر پاوه، روز چهارشنبه در زندان کرمانشاه اجرا شد در حالیکه اجرای حکم قبلی دادگاه برای اعدام این فرد پیشتر به دستور رئیس قوه قضائیه متوقف شده بود.
این پرونده براساس شکایت سه نفر به جریان افتاد که ادعا کرده بودند ماکوان هنگامی که سیزده سال سن داشت به آنان تجاوز جنسی کرده بود. به نوشته روزنامه اعتماد ملی، چاپ تهران، قرار بود این حکم در یک پارک در شهرستان پاوه اجرا شود اما به جای آن، بدون حضور وکیل مدافع و شاکیان پرونده، در زندان کرمانشان به اجرا در آمد. شعبه اول دادگاه کیفری کرمانشاه پس از رسیدگی به این پرونده، برای متهم حکم اعدام صادر کرده بود اما این حکم با اعتراض وکیل مدافع و خانواده متهم مواجه شد. در پی ارسال نامه والدین ماکوان برای آیت الله شاهرودی، رئیس قوه قضائیه، در مورد غیرقانونی بودن حکم صادره، وی دستور توقف اجرای حکم و رسیدگی مجدد به پرونده را صادر کرد. با اینهمه، چند روز پس از صدور این دستور، پرونده برای تایید حکم اعدام به تهران ارسال شد و بدون توجه به نظر قبلی رئیس قوه قضاییه تایید و اجرا شد. انتشار خبر اعدام این جوان ایرانی، انتقاد گروه های مدافع حقوق بشر را در پی داشته است که نسبت به کثرت موارد صدور و اجرای حکم اعدام و همچنین اعدام نوجوانان در جمهوری اسلامی ابراز نگرانی کرده اند.

به گفته والدین جوان پاوه ای فرزند آنان نخست به دلیل کشیدن سیگار در ماه رمضان بازداشت شد و بعدا بر اساس شکایت چند نفر در مورد تعرض جنسی پرونده ای علیه او تشکیل یافت

دروری دایک یک تن از سخنگویان عفو بین الملل در این رابطه گفت: “اعدام ماکوان، یک بی عدالتی فاحش است که عفو بین الملل، بی محابا آن را محکوم می کند”.

این سخنگو، دقت نظام قضایی ایران را زیر سوال برد و گفت باید دید که آیا آیت الله شاهرودی، رئیس قوه قضائیه ایران، کنترل موثری بر سازمان تحت امر خود دارید یا خیر.

عفو بین الملل همچین از افزایش اعدام ها، به ويژه اعدام افراد زیر سن هجده سال در ایران انتقاد می کند.

به گفته این گروه مدافع حقوق بشر، از ابتدای سال جاری میلادی، تاکنون 290 نفر در ایران اعدام شده اند.

هنوز خبر اعدام ماکوان از سوی منابع خبری دیگر در ایران تایید نشده و مقامات قوه قضائیه نیز درباره آن اظهار نظری نکرده اند.

جمهوری اسلامی مجازات اعدام را لغو نکرده و قوانین این کشور، که مقامات دولتی آنها را منتج از احکام اسلام می دانند، برای تعداد قابل توجهی از جرایم اشد مجازات را تعیین کرده است.

دادگاه های جمهوری اسلامی نیز در موارد متعدد به صدور احکام مجازات اعدام، شامل سنگسار، مبادرت کرده اند که به اجرا گذاشته شده و به این ترتیب، ایران را در شمار کشورهای دارای بالاترین شمار اعدام قرار داده است.

پرونده مبهم ماکوان

روز 6 آبان، روزنامه اعتماد ملی گزارش کرد که شعبه اول دادگاه کیفری کرمانشاه یک جوان ساکن پاوه به نام ماکوان را به جرم لواط در سن سیزده سالگی به اعدام محکوم کرده است.

جمهوری اسلامی به دلیل اجرای مجازات اعدام با انتقادهایی مواجه بوده است

به گزارش اعتماد ملی، ماکوان در مهرماه سال قبل، مصادف با ایام رمضان، و هنگامی که در پاوه مشغول کشیدن سیگار بود توسط ماموران آگاهی بازداشت شد.

این روزنامه به نقل از اعضای خانواده این جوان گزارش کرد که ماموران چند روز پس از دستگیری ماکوان، او را سوار بر الاغ در شهر گرداندند در حالیکه اعضای خانواده تصور می کردند که دلیل این مجازات، کشیدن سیگار بوده است.

به نوشته اعتماد ملی، خانواده ماکوان گفتند که چند روز بعد تعدادی جوان “به دادسرا احضار شدند” و شکایت کردند که ماکان در سن سیزده سالگی آنان را مورد تعرض قرار داده و خواسته است تا این موضوع را با کسی در میان نگذارند.

همین روزنامه در گزارشی در شماره روز 25 آبان نوشت که پس از صدور حکم اعدام، خانواده متهم طی نامه ای به رئیس قوه قضائیه گفتند که حکم بدون توجه به قوانین اسلامی و موازین قانونی صورت گرفته و خواستار لغو آن شدند.

به نوشته اعتماد ملی، آیت الله شاهرودی نیز این حکم را مغایر قوانین شرع و فتاوی آیت الله خامنه ای تشخیص داد اما ظاهرا مقامات قضایی کرمانشاه با اتکا به “علم قاضی” همین حکم را به تایید دیوان عالی کشور رساندند و به اجرا گذاشتند.

به گفته والدین و وکیل مدافع ماکوان، شاکیان پرونده پس از آغاز محاکمه اظهار داشتند که شهادت آنان دروغ بوده است و همچنین، این مساله نیز مطرح است که اگر جرمی هم واقع شده باشد، هنگامی صورت گرفته که متهم سیزده سال داشته و از نظر شرعی و قانونی صغیر محسوب می شده است.

به گفته والدین ماکوان، دادگاه به منظور قانونی جلوه دادن رای خود مدعی شده بود که جرم در سن سیزده سالگی آغاز شد و همچنان ادامه داشته است اما از اعزام شاکیان به پزشکی قانونی برای مشخص شدن واقعیت این اتهام خودداری ورزید.

اعتماد ملی نوشته بود که شاکیان پرونده خود درخواست کرده بودند توسط پزشکی قانونی تحت آزمایش قرار گیرند اما این درخواست نیز اجابت نشد.

روز چهارشنبه، 5 دسامبر، دیده بان حقوق بشر، از سازمان های مدافع حقوق بشر، با صدور بیانیه ای خواستار خودداری از اجرای حکم ادعام ماکوان مولودزاده شد و گفت که نه تنها شاکیان پرونده شکایت خود را پس گرفتند بلکه متهم نیز گفته است که اعترافات او در جریان بازجویی تحت فشار اخذ شده بود.

به گفته دیده بان حقوق بشر، وکیل مدافع آقای مولودزاده روز 12 آذرماه اظهار داشت که از شعبه مربوطه در دادگاه کرمانشاه به وی اطلاع داده اند که حکم اعدام می تواند اجرا شود حتی اگر تکلیف تقاضای اعاده دادرسی هم مشخص نشود.

در حالیکه منابع قضایی جمهوری اسلامی هنوز در مورد اعدام جوان بیست ساله پاوه ای اظهار نظری نکرده اند، مشخص نیست که آیا این پرونده به مرحله دوم دادرسی رسید و در چنین صورتی، آیا ایرادهای وارد شده به مرحله اول مورد توجه قرار گرفت یا نه.

Makwan Mouloudzadeh was executed

Makwan Mouloudzadeh, an Iranian Kurd, has been hanged despite his alleged rape victims withdrawing their accusations and a judicial review and stay of execution being ordered into the sentence.

Makwan Mouloudzadeh, 20, was accused of raping raping three teenage boys when he was 13 years old.

The hanging took place on Wednesday morning at a prison in Kermanshah province in western Iran.

“On 11 November the head of the justice administration of Kermanshah received an order from the judiciary head, Ayatollah Mahmoud Hashemi Shahroudi, to stop the verdict being carried out,” the lawyer, Saeed Eqbali, was quoted as saying.  “But the case, which was supposed to be reviewed in Tehran, was sent back from there to Kermanshah, and the execution was carried out quickly,” the lawyer said.

Clarisa Bencomo of the Human Rights Watch (HRW) group told Reuters news agency she had received information that Mr Mouloudzadeh’s family had been told to come and pick up his body.  Her organisation had spoken to people who had seen the body, she said.

Makwan was arrested in September 2006 after three boys complained to police he had raped them seven years earlier.  During court proceedings, Makwan withdrew a confession he had made earlier, saying it had been the result of coercion by the police, the US-based group says and the alleged victims also later withdrew their claims.

As a state that is party to the Convention on the Rights of the Child and the International Covenant on Civil and Political Rights, Iran has undertaken not to execute child offenders.

Iran has executed at least five minors so far in 2007 and 27 minors since 1990.

Another Iranian Child executed

According to the website Iran Human Rights, Mohammadreza Tork (18) was hanged this morning in a prison in the city of Hamedan. He was together with two other men convicted of a murder that was allegedly committed when he was 16 years old. The two others, who are believed to be in Mohammadreza’s family, were hanged right after. They are identified as Manuchehr Tork (30) and Safarali Waramzyaar (31).

Mohammadreza is the seventh child executed in Iran this year.

The others are:

Mohammad Mousavi, Male-16 (executed on April 22, 2007)
Saeed Kamberzai, Male-17 (executed on May 28, 2007)

تلاش برای توقف حکم اعدام یک نوجوان در همدان

 

محمدرضا ترک به دلیل ارتکاب قتلی که در سن 16 سالگی مرتکب شده در معرض اجرای حکم اعدام قرار دارد. چهاردهم آبان سال 84 در پی یک نزاع خانوادگی در روستای زمان آباد شهرستان ملایر سه نفر به نام های جواد ورمزیار،5 ساله، حسن مالمیر، 10 ساله و یوسف مالمیر، 14 ساله به قتل رسیدند.
در رابطه با این پرونده چهار تن به نام های محمدرضا ترک، منوچهر ترک و صفرعلی ورمزیار و قربانعلی ترک در تاریخ 18/8/84 دستگیر و به زندان شهرستان همدان منتقل شدند. اولین جلسه دادگاه در تاریخ 1/12/84 برگزار شد و متهمان به ارتکاب قتل اعتراف نمودند. دادگاه پس از رسیدگی با توجه به شواهد موجود در پرونده و طبق قانون مجازات اسلامی متهمان را به قصاص نفس محکوم نمود. قربانعلی ترک، پدربزرگ محمدرضا که قتل ها به توصیه و تحریک وی انجام شده از سوی دادگاه به 5 سال حبس محکوم شد.
حکم صادره در دیوان عالی کشور تأیید و جهت اجرا به دايره اجرای احکام همدان ارسال شده است. محمدرضا ترک به اتهام انجام جرمی که در سن شانزده سالگی مرتکب شده ساعت 6 صبح فردا در زندان همدان اعدام خواهد شد. محمدرضا ترک متولد چهارم مرداد 1368 است و در زمان وقوع جرم طبق قوانین جزایی کودک محسوب می شود. وی در مرداد امسال با رسیدن به سن بلوغ قانونی از کانون اصلاح و تربیت همدان به زندان عمومی منتقل شده است. با ذکر این نکته که دادستان و مقامات قضایی همدان نیز نارضایتی خود را از اجرای حکم وی اعلام داشته اند. حکم که در ابتدا بنا بود تا در ملأ عام اجرا شود به دستور دادستانی در زندان اجرا خواهد شد.
محمدرضا ترک در حالی در معرض اعدام قرار دارد که طبق نص صريح بند 5 ماده 6 ميثاق بين المللي حقوق مدني و سياسي: «حكم مجازات مرگ نبايد براي جرم‌هايي كه افراد زير 18 سال مرتكب شده اند صادر شود». میثاق حقوق کودک نیز در ماده 37 خود « صدور حکم مرگ را برای کودکان زیر 18 سال ممنوع اعلام کرده است.»

ماده 9 قانون مدني در مورد عهود بين‌المللي اذعان داشته كه« مقررات عهودي كه بر طبق قانون اساسي بين دولت ايران و ساير دول منعقد شده باشد در حكم قانون است» و اصل 77 قانون اساسي اجراي عهدنامه‌ها، مقاوله نامه‌ها و موافقت‌نامه‌هاي بين‌المللي را منوط به تصويب مجلس دانسته است. ميثاق ياد شده در سال 1354 به تصويب مجلس رسيده و تاكنون نيز قانوني مخالف با اين بند ميثاق وضع نشده، بنابر اين دادگاه‌ها مکلفند مفاد ميثاق را در احكام خود لحاظ كنند. مضاف به اين ‌كه در روابط بين‌الملل، اعتبار عهود بيش از قانون داخلي است و اختيار قانونگذار را در وضع قانون معارض محدود مي‌كند در صورتي‌كه قضات محاکم آن را ناديده مي گيرند.

Iran executes 2 more children

According to the state-run ISNA news agency, Iran executed 9 people last Wednesday at the Evin prison in Tehran.

One of those executed was identified by ISNA as Babak , 23 years old, convicted of murder in January 2002.

However Iran Human Rights website in Norway reported that “According to reliable sources, Babak Rahimi who was among those executed on October 17., at the Evin prison in Tehran, was 17 years old when he reportedly convicted the crime he was executed for. “

Another person who was reported by ISNA to have been executed was Hossein, convicted of murder of another man in 2004, who allegedly had tried to rape him.  Hossein’s age was not mentioned in the report.

Following the report by ISNA , Iran Human Rights website also reported that: 

 ”According to reliable sources, one of those executed on Wednesday October 17 in Tehran, was Hossein Gharabaghloo.  In the news broadcasted by the state-run ISNA news agency he was just identified as “Hossein” and his age was not mentioned. It is now confirmed that Hossein Gharabaghloo was among those executed on Wednesday. Hossein Gharabaghloo was 16 when he reportedly stabbed another young man with the name Mahmoud to death during a fight on 1 December 2004 at a place near Tehran. He was sentenced to death in 2006.”

Babak Rahimi was not among SCE’s list of the children known to face execution in Iran, however Hossein Ghabaghloo was listed among the 81 children recorded to face execution.


The 2 recent child executions increases the number of children reported to have been executed in 2007 to 6:

  • Mohammad Mousavi, Male-16 (executed on April 22, 2007)
  • Saeed Kamberzai, Male-17 (executed on May 28, 2007)
  • Babak Rahimi, Male- 17 (executed on October 17, 2007)
  • Hossein Gharabaghloo – 16 (executed on October 17, 2007)
  • 2 Afghan Boys executed in Iran (reported by BBC and Afghanistan Independent human rights commission )

All the child executions are pre-approved by Iran’s head of judiciary Ayatollah Shahrudi. Iran has been executing scores of youth in the past few month without reporting much information about them. It is anticipated that the some of the executed may have been less than 18 years old at the time of the alleged crime.

Stop Child Executions campaign warns the United Nations and all the governments and human rights organizations that unless the international community assumes a much stronger, unanimous and effective role in implementation of the  International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC with respect to its member countries, especially the Islamic regime of Iran, at the current rate of mass executions in Iran many more children will be facing executions in the coming months. Signed international conventions of child rights and similar treaties are meaningless if the United Nations member countries such as Iran are not held responsible to their obligations.

Stop Child Executions Campaign strongly condemns the Iranian regime’s cruel execution of the children and it’s wide violations of children’s human and legal rights.

Iran executes 2 Afghani children, 17 more to be executed

According to BBC NEWS (Persian), the parliament of Afghanistan announced their concern about Afghani children facing execution in Iran and asked Afghan government to resolve this issue with Islamic regime in Iran through it’s diplomatic channels. Afghan members of parliament complained that regime of Iran’s actions are in violation of the international children rights conventions. 

Additionally independent human rights commission of Afghanistan reported that there were initially 19 Afghani children on the execution row, however two of them were recently executed. Commission official Farid Hamidy stated that these children were smuggled to Iran with fake passports and were accused of drug trafficking. The children are being kept imprisoned until they grow to the age of 18 and then executed.

Stop Child Executions Campaign has contacted Independent Human Rights Commission of Afghanistan for more documents and names of the 17 Afghani children facing execution in Iran as well as name and information of the two who were recently executed.

Based on this news the recorded number of children facing execution in Iran jumps from 80 to 97 and the number of children executed in 2007 in Iran are increased from 2 to 4.
