Nobel Peace Laureate condemns child executions

In a report by AFP today, nobel peace laureate Shirin Ebadi and her human rights group spoke out against the execution of 4 minors:

“Four minors who were under 18 at the time of committing the crimes have been hanged,” the group said in a report on the status of human rights in Iran for three months to September.
The AFP report went on to say:

The conservative judiciary maintains that minors are not executed, and Iran is a party to international conventions on child rights, whose signatories commit not to execute convicts who were under 18 at the time of an offence.Ebadi’s rights group report identified the four as Rahman Shahidi and Hassan Mozaffar, who were hanged in the southern port city of Bushehr, Reza Hejazi who was executed in the central city of Isfahan and Behnam Zaree, executed in the southern city of Shiraz.

Shirin Ebadi is number  5805th person to sign the Stop Child Executions petition.

14 آبان ماه 1387- کمپین بین المللی حقوق بشر درایران و دیده بان حقوق بشر امروز مشترکا اعلام کردند که در تاریخ 9 آبان ماه 1387، هفتمین نوجوان در سال جاری میلادی در ایران در شرایطی به دار آویخته شد که دقیقا دو روز قبل از آن مقامات ایرانی “با قاطعیت هر گونه اعدام نوجوانان در ایران را تکذیب کرده بودند.” این دو سازمان حقوق بشری مشترکا از مقامات ایرانی خواستار پایان دادن فوری به اعدام نوجوانان شدند.

ایران تنها کشوری است که در سال جاری میلادی جوانان بزهکار را اعدام کرده است. همچنین ایران در اعدام نوجوانان در جهان از همه کشورها پیشی گرفته است و در سه سال و نیم گذشته، بیش از 80 درصد اعدام های نوجوانان (27 نفر از 33 نوجوان اعدام شده در سطج حهان) توسط ایران انجام شده است. در حال حاضردر ایران، حداقل 130 نوجوان بزهکار در صف انتظار اعدام هستند.

در تاریخ 9 آبان ماه 1387، دادگستری کل استان اصفهان اعلام کرد که حکم اعدام غلامرضا ح. نوجوان افغانی که مرتکب قتل شده بود، در صبح آن روز اجرا شده است. بر اساس اطلاعات مندرج در وب سایت دادگستری اصفهان، غلامرضا در هنگام اعدام 19 سال داشت و بخاطر قتلی که در تاریخ 29 آبان ماه 1385 مرتکب شده بود، یعنی در زمانی که 17 سال داشت، به اعدام محکوم شده بود.  
 
مقامات ایرانی به کرات اعدام نوجوانان بزهکار را تکذیب کرده اند و اخیرا هم در تاریخ 7 آبان ماه 1387، در زمان بررسی گزارش دبیر کل سازمان ملل متحد در باره اعدام نوجوانان و نقض حقوق بشر در ایران، مقامات ایرانی در بیانیه ای مجددا آن را تکذیب کردند. در اوایل ماه اکتبر سال جاری میلادی نیز، زمانی که مباحثات سالیانه سازمان ملل متحد در باره حقوق کودک در جریان بود، یک مقام ارشد قضایی ایران اعلام کرد که طی بخشنامه ای احکام اعدام همه نوجوانان بزهکار تخفیف می یابند. سه روز بعد از اعلام این خبر، همان مقام قضایی به خبرگزاری آسوشیتدپرس گفت که این بخشنامه فقط شامل حال کسانی می شود که پرونده آنها به مواد مخدر مربوط می شود و تاثیری بر احکام اعدام نوجوانان بزهکاری که در حال حاضر در صف اعدام هستند، نخواهد داشت.  
 
هادی قائمی؛ همآهنگ کننده کمپین بین المللی حقوق بشر در ایران گفت: ” چنین بنظر می رسد که صدور این بیانیه در زمانی که وضعیت حقوق بشر ایران در سازمان ملل متحد در جریان بود، بیشتر نمایش یک صفحه مه آلود بوده است.”  
 
کمپین بین المللی حقوق بشر در ایران و دیده بان حقوق بشر با هر گونه مجازات اعدام به هر دلیلی بخاطر نقض حق حیات و با توجه به این که ماهیتی غیر بشری و خشن دارد، مخالفند. ایران، الزامات روشن و معین حقوق بشر را بخصوص با صدور احکام اعدام برای کسانی که در سن قبل از 18 سالگی جرمی مرتکب شده اند، زیر پا می گذارد. در دو پیمان اصلی حقوق بشر؛ میثاق بین المللی حقوق مدنی و سیاسی و پیمان حقوق کودک، که ایران آن ها را تصویب کرده است، اعدام نوجوانان منع شده است.  
 
کمپین بین المللی حقوق بشر در ایران و دیده بان حقوق بشر از ایران خواستند که اجرای احکام اعدام نوجوانان را که در زمان ارتکاب جرم کمتر از 18 سال داشتند، متوقف کرده، صدور احکام اعدام را قانونا برای نوجوانان در همه موارد منع و الزامات بین المللی حقوق بشر را رعایت کند.  

100 000 dollars in blood money

Reza Alinejad’s family had their last mediation with the family of the victim and it was concluded that the Alinejad family would have to pay $100,000 as blood money “diyeh” in order for the officials not to execute Reza.
 
Their home is worth $50 000 so they are using that as a security deposit. They now need another  $50,000.00. They are currently fundraising in Iran and asking some banks for loans.  They have asked that if anyone can help front some money for them to borrow in order to meet the deadline next week, they would eventually pay them back.

Background:

Reza Alinejad was no more than 17 years old when he defended himself and his friend Hadi Abedini in fight with two other boys that landed him in prison for the last six years in Adel Abad in Shiraz, Iran.

He is now 21 years old.


 Reza Alinejad and his friend Hadi Abedini were on the sidewalk of Emamzadeh Hassan busy eating when they were reproached by two men Esmail Dooroodi and Mohammad Firouzi.

Insults were exchanged which triggered a fight.

The two men were concealing Nunchucks (martial arts tool) under their clothes and tried to hit Alinejad and his friend.

Alinejad defended himself with a knife in one hand while protecting his face with the other hand. Without intending to kill Dooroodi, his knife cut his neck which ended up being fatal.

World condemns Iran for 7th child execution this year

On Friday October 31st, SCE reported the execution of Gholamreza Saeedi  also referred to as Gholamreza H in Iran.
Stop Child Executions Organization, Government officals, and Human Rights organizations worldwide including Human Rights Watch and Amnesty International condemn Iran for the 7th execution of a child this year. As reported by AI:

“Gholamreza H., an Afghan national, was aged 19 at the time of his execution but he was only 17 years of age, and so a juvenile, at the time of the crime of which he was convicted. This was the stabbing to death of another Afghan boy, Shir-Agha Hoseini, on 29 November 2006. Gholamreza H. was tried before Branch 17 of Esfahan’s Penal Court and sentenced to death. He is reported to have confessed to the killing, stating that the victim had been harassing his sister and insulting his honour, and that he had bought a knife, arranged to meet the boy and stabbed him. His sentence was upheld by Branch 33 of the Supreme Court and confirmed by Ayatollah Mahmoud Hashemi Shahroudi, the Head of the Judiciary. In a news release posted on its website, Esfahan’s Judiciary announced that Gholamreza H.’s execution was carried out on the morning of 29 October 2008. “

Last year when our organization Stop Child Executions was gaining momentum, the Islamic Republic of Iran filtered our main website www.stopchildexecutions.com to the Iranian population. This year, after our recent news update about how Iran backtracked on their word to end child executions, they ended up blocking the SCE newsblog http://scenews.blog.com . At the same time they also banned attorney Mohammad Mostafaei’s weblog in Iran http://www.mostafaei.blogfa.com/. Mr. Mostafaei is the leading attorney in Iran who concentrates on child executions. He currently represents more than 20 juveniles facing the death penalty . It is obvious that Iran is facing pressure to reform their law and put a permanent end to child executions.

Iran’s regimes’ recent lies to United Nations General Assembly, Ahmadinejad’s lie to New York times denying child executions in Iran or blocking SCE websites that simply report the facts with photos, names and details with cases numbers etc (www.stopchildexecutions.com/scedata.aspx) would not change the truth about Iran’s violation of international human and children rights conventions. If Islamic Republic wase solid on their law and not ashamed of their practices they wouldn’t feel the need to block websites that simply expose Iran’s human rights abuses.

13 year old girl stoned to death in Somalia

A girl stoned to death in Somalia this week was 13 years old, not 23,
contrary to earlier news reports. She had been accused of adultery in
breach of Islamic law.

Aisha Ibrahim Duhulow was killed on Monday 27 October, by a group of 50
men in a stadium in the southern port of Kismayu, in front of around
1,000 spectators. Somali journalists who had reported she was 23 have
told Amnesty International that they judged her age by her physical
appearance.

Inside the stadium, militia members opened fire when some of the
witnesses to the killing attempted to save her life, and shot dead a boy
who was a bystander. An al-Shabab spokeperson was later reported to have
apologized for the death of the child, and said the militia member would
be punished.

At one point during the stoning, Amnesty International has been told by
numerous eyewitnesses that nurses were instructed to check whether Aisha
Ibrahim Duhulow was still alive when buried in the ground. They removed
her from the ground, declared that she was, and she was replaced in the
hole where she had been buried for the stoning to continue.
 
Aisha Ibrahim Duhulow was accused of adultery, but sources told Amnesty
International that she had in fact been raped by three men, and had
attempted to report this rape to the al-Shabab militia who control
Kismayo. It was this act that resulted in her being accused of adultery
and detained. None of men she accused of rape were arrested.

She was detained by militia of the Kismayo authorities, a coalition of
Al-shabab and clan militias. During this time, she was reportedly
extremely distressed, with some individuals stating she had become
mentally unstable.

7th child executed in Iran this year

Stop Child Executions organization regrets to inform that another minor was executed this week, bringing a total of 7 children executed this year.

On Wednesday October 29th,  Gholamreza Saeedi an Afghan national residing in Iran was executed by hanging in a prison in Isfahan, Iran . This  is in direct violation of the International Covenant on Civil and Political Rights (ICCPR) and to the Convention on the Rights of the Child (CRC), to which Iran is state party.

اجـراي حكـم قصـاص یک نوجوان کمتر از 18 سال در اصفهـان

 

صبح هشتم آبانماه جوان 19 ساله اي كه در سال 85 فردي را با ضربات چاقو به قتل رسانده بود به دار مجازات آويخته شد.

به گزارش سايت دادگستري كل استان اصفهان http://dadgostary-es.ir/cms/index.php?option=com_content&task=view&id=1290&Itemid=1در تاريخ 29/8/85 جسد مجهول الهويه اي در يكي از خيابانهاي شهرستان نجف آباد اصفهان كشف مي گردد، پس از عزيمت مأمورين در بررسي هاي اوليه مشخص مي شود جسد متعلق به جواني افغاني به نام شيرآغا حسيني بوده كه ظاهراً در پي يك نزاع خونين و بر اثر اصابت ضربات  چاقو به قتل رسيده است با حضور بازپرس ويژه قتل دستور معاينه جسد و انتقال آن به پزشكي قانوني صادرو  تحقيقات آغاز مي گردد.

در بازجوئي از چند تن از دوستان مقتول مشخص مي شود شخصي به نام غلامرضا . ح كه او هم افغاني و از دوستان مقتول بوده با او تماس گرفته و ظاهراً در قرار ملاقات بين آنها قتل به وقوع پيوسته است .

غلامرضا پس از احضار در بازجوئي اوليه لب به اعتراف گشوده و اظهار مي دارد: مدتي بود كه دوستانم مدام به من كنايه مي زدند كه شيرآغا (مقتول) براي ناموس و خواهرت حرفهايي مي زند اين مسئله شديداً مرا آزار مي داد و باعث آبروريزي ام شده بود از اين رو بالاخره تصميم گرفتم كه به اين ماجرا پايان دهم و با خريد يك عدد چاقو از حيدرآباد اصفهان به سمت نجف آباد حركت كردم با شيرآغا تماس گرفتم و با او قرار گذاشتم وقتي در محل ملاقات با او رو در رو شدم با عصبانيت به او حمله كرده و با چاقو ضربه اي محكم به شكم او وارد آوردم و وقتي كه خم شد چند ضربه ديگر هم به پشت و كمر او وارد آورده و از صحنه فرار كردم.

بر همين اساس و نظر به تقاضاي اولياي دم مقتول قضات شعبه 17 كيفري استان اين قاتل را گناهكار تشخيص داده و به موجب مواد مربوطه در قانون مجازات اسلامي و بدون در نظر گرفتن کنوانسیون حقوق کودک وي را به قصاص نفس محكوم نمودند و اين حكم پس از تأئيد ناعادانه شعبه 33 ديوانعالي كشور و استيذان رئيس قوه قضائيه صبح امروز در محوطه زندان مركزي اصفهان به اجرا در آمد.

Statements made by country officials at the 63rd General Assembly Third Committee

In 2007, New Zealand had co-sponsored the General Assembly resolution calling for a moratorium, which represented a significant milestone in the quest for its eventual abolition. Five countries (Iran, Sudan, Yemen, Saudi Arabia, Pakistan)  continued to execute juvenile offenders and had carried out 32 such executions in the past three years. She urged those States to take immediate steps to prohibit that practice by law and, while such efforts were ongoing, to adopt a moratorium on all executions of juvenile offenders.

LIE #1: Yemen denies implementing the death penalty for minors

YEMEN: In a dialogue session following the introduction of the reports, the representative of Yemen said his delegation was particularly surprised by the information included in paragraph 43 of the report of the Secretary-General on the moratorium on the death penalty (A/63/293), which stated that Yemen was one of five countries who continued to implement the death penalty against persons under 18 years of age. That claim was “totally groundless” and had been based on information from a non-governmental organization and not from State figures. The Secretary-General’s report on the issue should be based on State information and not on information from other groups or countries. Yemen had amended its crime and punishment law in 1994, and, currently, the maximum penalty against persons under 18 years of age in the country was imprisonment for a duration of 10 years. He called on the Secretariat to clarify the situation officially and asked for such misinformation to be avoided in the future.

STOP CHILD EXECUTIONS RESPONSE: If Yemen amended its crime and punishment law in 1994 where the maximum penalty for persons under 18 years of age is 10 year imprisonment, why then was Hafez Ibrahim sentenced to death for a crime allegdedly committed when he wa 16 years old. Why did did Ibrahim’s family have to pay 25 million Yemeni riyals (approximately USD$126,217) to the family of the victim as a compensation amount to pardon him for exchane of his lifein October 2007? What about Walid Haikal who has been facing execution in Yemen for over 7 years from the time he was 15 years old. Why was Walid Hussein Haykal sentenced to death at age 16 year old when it is documented in his father’s passport issued in the Yemeni consulate in Jeddah, Saudi Arabia where he was born?

LIE #2: Iran rejects claim that Iran continues to use the death penalty against juveniles.

IRAN. Flagging the same report, the representative of Iran categorically rejected the claim made in paragraph 43 that Iran continued to use the death penalty against juveniles. Discussion surrounding the adoption of the General Assembly resolution on a moratorium of the death penalty had demonstrated the deep divide among Member States on that issue, and his delegation continued to hold strong reservations regarding the implications of a moratorium, as did many others. Those reservations aside, he said that persons in charge of preparing the report should have ensured that the information included was accurate. In the case of Iran, the information had come from a non-governmental organization and, before allowing those figures to be included in the report, the Secretary-General should have verified those figures with intergovernmental stakeholders or other officials within the country. At the very least, he added, the countries concerned should have been consulted on the information that was going to be included in the report.

Introduction of Draft Resolutions

SEYED HOSSEIN REZVANI ( Iran) said strengthening cooperation in the field of human rights helped promote mutual understanding and good neighbourliness among States. Due to different historical, regional, religious, cultural and national particularities, as well as differences in social systems, levels of development and concepts of value, it was only natural to have different views on human rights. Countries should be allowed to take measures to protect and promote human rights, while taking into account their own national conditions. It was neither practical nor feasible to demand that all countries adopt the same development model. The international community should, on the basis of mutual respect and through dialogue, deepen their mutual understanding and cooperate more to promote human rights. Cultural diversity should not be a cause for division within the international community, but should be viewed as an asset that enriched the common heritage of all peoples. In light of that, advancing a “policy of cultural hegemony” should be avoided. The practice of listening to others, rather than confronting or offending them, should be cultivated among those participating in international politics.

STOP CHILD EXECUTIONS RESPONSE: Iran continues to violate international human rights law. It has executed 6 children this year alone, and over 140 minors remain on death row awaiting execution.

LIE #3: Iran ensures compliance with international commitments
Also in reply to the statement made by France’s delegation, the representative of Iran said his delegation categorically rejected the allegations made regarding the execution of minors in his country. As a party to a number of major human rights instruments, Iran had ensured compliance with its international commitments, particularly with regard to restricting the application of the death penalty to the perpetrators of only the most heinous crimes. In addition, there had been no cases of death sentences carried out by stoning in his country in recent years, since a moratorium was in place to prevent such actions. The degree of freedom of expression in the country was evident in the publication of more than 300 news dailies, as well as other forms of media, which were all free to discuss and debate a wide range of political issues in the country.

STOP CHILD EXECUTIONS RESPONSE:
Iran has signed the ICCPR International Covenent on Civil and Political Rights and the Charter of the Rights of the Child which prohibits the execution of those who have comitted an offence before the age of 18 years. Iran continues to violate these treaties.

Lie #4: Sudan denies no penalties were applied to minors in he country, neither the death penalty nor any other.

SUDAN. Sudan’s delegate, referring to the same report, said the Secretary-General had exceeded his mandate by including information from non-State actors. The moratorium on the death penalty was a controversial issue that had not achieved consensus. Member States had given the Secretary-General a mandate to publish a report on the implementation of the moratorium, but it did not include permission to base his reports on information culled from non-governmental organizations or civil society. Regarding the Sudan’s inclusion in paragraph 43, he said that the information was incorrect and no penalties were applied to minors in the country, neither the death penalty nor any other. He asked Mr. Mbaidjol, who had provided the Secretary-General that information, why such groundless and inaccurate information was included in an official report. He also asked to be provided with the names of the minors that were alleged to have been executed in his country.

ایران یکی از معدود کشورهایی است که هنوز در آن کسانی که در سن کمتر از ۱۸ سالگی مرتکب جنایت شده باشند، اعدام می شوند.

قوه قضائیه ایران اخیراً بخشنامه ای در جهت محدود کردن اعدام این دسته افراد صادر کرد اما مقامات ایرانی می گویند قوانین اسلامی امکان دخالت آنان را در این امر محدود می کند.

مطابق این قوانین اعضای خانواده یک مقتول می توانند تحت عنوان قصاص خواستار اعدام قاتلی شوند که در نوجوانی مرتکب قتل شده است.
